1. Acceptance of Terms

By accessing or using form.land (the “Service”), operated by form.land Technologies Inc. (“we”, “us”, or “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

form.land is a real estate development intelligence platform that provides feasibility scoring, financial modeling, negotiation frameworks, opportunity mapping, and related analytical tools for properties in Vancouver, British Columbia, Canada. The Service aggregates publicly available municipal data, applies proprietary scoring models, and generates preliminary feasibility analyses.

All data, scores, projections, and recommendations provided through the Service are for preliminary feasibility purposes only. They do not constitute legal advice, professional appraisal, engineering assessment, or final tender advice. Users should obtain independent professional advice before making any development or investment decisions.

3. User Accounts

To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Reproduce, distribute, or resell data or reports generated by the Service without prior written consent
• Attempt to reverse-engineer, decompile, or extract source code from the Service
• Use automated systems or bots to access the Service in a manner that exceeds reasonable use
• Interfere with the security or integrity of the Service or its underlying infrastructure
• Misrepresent form.land data as a professional appraisal, legal opinion, or engineering assessment

5. Subscription and Payment

Certain features of the Service require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis and are non-refundable except as required by applicable law. We reserve the right to modify pricing with 30 days advance notice.

6. Intellectual Property

The Service, including its scoring algorithms, data models, design, and content, is owned by form.land Technologies Inc. and is protected by Canadian and international intellectual property laws. Reports generated for your account are licensed for your internal use only. The underlying methodology, scoring engine, and platform remain our exclusive property.

7. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the data is complete, accurate, or current. Municipal zoning, fees, and planning policies change frequently and there may be delays in reflecting updates in the Service. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components.

8. Limitation of Liability

To the fullest extent permitted by applicable law, form.land Technologies Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, or business opportunities, arising out of or related to your use of the Service, even if advised of the possibility of such damages.

To the fullest extent permitted by applicable law, our total aggregate liability to you arising out of or related to the Service, under any theory of liability, shall not exceed the greater of (a) the total fees you paid us in the 12 months preceding the event giving rise to the claim, or (b) CAD $100. This cap applies whether or not we have been advised of the possibility of such liability, and even if a remedy fails of its essential purpose.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction located in Vancouver, British Columbia.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Service with at least 30 days advance notice. Your continued use of the Service after such changes constitutes acceptance of the revised Terms.
